Florida technical recruiting and hiring rules

Florida holds three of the metro markets on this site.

Tampa has MacDill Air Force Base, home to U.S. Central Command and U.S. Special Operations Command; the Space Coast has Kennedy Space Center, Cape Canaveral Space Force Station, Patrick Space Force Base and L3Harris's headquarters in Melbourne; Orlando has the University of Central Florida, the Central Florida Research Park and a simulation and training industry around it. Requisitions run from non-cleared aerospace manufacturing to TS/SCI at the commands.

Florida regulates little at the posting stage but rewrote its non-compete law in 2025. The rules below are current at the time of writing, each with its source.

Hiring rules in Florida that matter to employers

Summaries are general information current at the time of writing and are no substitute for counsel.

Pay transparency in job postings
Florida has no statewide salary range disclosure requirement; it does not appear on the Society for Human Resource Management's state-by-state list of pay transparency laws.
Salary history
Florida has no statewide or local salary history ban on the same list.
Fair-chance hiring
Florida does not appear in the National Employment Law Project's guide to states with statewide ban-the-box policies.
Non-compete agreements
Section 542.335, Florida Statutes, requires a restrictive covenant to be in a writing signed by the person against whom it is enforced and supported by a legitimate business interest, and for an employee it presumes a restraint of six months or less reasonable and a restraint of more than two years unreasonable. The Florida CHOICE Act, Chapter 2025-213, effective July 1, 2025, adds a second regime for covered employees earning more than twice the annual mean wage of the county specified in the statute: covered garden leave agreements of up to four years' paid notice, and covered non-compete agreements of up to four years, are enforceable if the employer provided the agreement at least seven days before the offer expired, advised the employee in writing of the right to seek counsel, and obtained a written acknowledgment about confidential information or customer relationships, and courts must enter preliminary injunctions on alleged breaches. Section 542.335 continues to govern agreements outside the Act.
At-will employment
Florida employment rests on the at-will default that applies across the United States, with the statutory rules on this page as the main exceptions; the firm found no Florida agency page summarizing the doctrine, so employers should take advice on its current application.
E-Verify and drug-free workplaces
Section 448.095 provides that, beginning July 1, 2023, a private employer with 25 or more employees shall use E-Verify to verify a new employee's employment eligibility within three business days after the employee begins working for pay, and every public agency must use it. Under Section 440.102, an employer that implements a drug-free workplace program meeting the statute's testing standards may be eligible for a five percent credit on its workers' compensation premium.

Questions about hiring in Florida

Which Florida engineers fall under the CHOICE Act?

Employees or individual contractors who earn, or are reasonably expected to earn, more than twice the annual mean wage of the county specified in the statute, which in practice means senior engineers, architects and managers. Below that line Section 542.335 applies. An employer proposing a covered agreement must deliver it at least seven days before the offer expires and advise the candidate in writing of the right to seek counsel.

Does E-Verify apply to a small defense subcontractor in Florida?

Private employers with 25 or more employees have been required to use E-Verify for new hires since July 1, 2023, and every public agency must use it. Smaller private employers are outside the statutory mandate, though many use the system anyway, and federal contracts often require it on their own terms.
