Alabama technical recruiting and hiring rules

Alabama's cleared market is Huntsville, where Redstone Arsenal hosts Army Materiel Command, Army Aviation and Missile Command, the Missile Defense Agency, the Space and Missile Defense Command, the Defense Intelligence Agency's Missile and Space Intelligence Center, two FBI centers and NASA's Marshall Space Flight Center, with Cummings Research Park and its roughly 300 companies next door and United Launch Alliance's factory in Decatur down the road.

Requisitions run from Secret for missile and aviation programs to TS/SCI for intelligence and space work.

Alabama regulates little at the posting stage, so the clearance and the labor category decide most searches. The rules below are current at the time of writing, each with its source.

Hiring rules in Alabama that matter to employers

Summaries are general information current at the time of writing and are no substitute for counsel.

Pay transparency in job postings
Alabama has no statewide law requiring pay ranges in job postings or disclosure of pay to applicants.
Salary history
The Clarke-Figures Equal Pay Act, Code of Alabama Section 25-1-30, signed on June 11, 2019, provides that an employer shall not refuse to interview, hire, promote or employ an applicant, or retaliate against an applicant, because the applicant does not provide wage history. The statute does not bar asking the question; it bars penalizing an applicant who declines to answer. The Act also prohibits paying employees of one sex or race less than employees of another for equal work.
Fair-chance hiring
Alabama does not appear in the National Employment Law Project's guide to states that have adopted statewide ban-the-box policies, for public or private employment.
Non-compete agreements
Code of Alabama Section 8-1-190, enacted by Act 2015-465, provides that every contract restraining a lawful profession, trade or business is void except as the section allows, and it allows an employee to agree to refrain from a similar business within a specified geographic area while the employer carries on a like business, subject to reasonable restraints of time and place, and to agree not to solicit current customers. Employee restraints of two years or less are presumed reasonable, and non-solicitation restraints of eighteen months, or as long as post-separation consideration is paid, are presumed reasonable.
At-will employment
Alabama employment rests on the at-will default that applies across the United States, with the statutory rules on this page as the main exceptions; the firm found no Alabama agency page summarizing the doctrine, so employers should take advice on its current application.

Questions about hiring in Alabama

Can an Alabama employer ask an applicant for their current salary?

The Clarke-Figures Equal Pay Act bars refusing to interview, hire or promote an applicant, or retaliating, because the applicant does not provide wage history; it does not bar the question itself. Employers hiring across states often adopt a no-inquiry policy to meet the stricter rules in Colorado, Maryland or California.

What clearance levels do Huntsville requisitions usually carry?

Secret for most missile, aviation and engineering support work on Redstone Arsenal and in Cummings Research Park, Top Secret for program offices, and TS/SCI for the intelligence and space programs. The Huntsville page names the tenants and employers that shape the market.
