Ohio technical recruiting and hiring rules

Ohio's cleared market is Dayton, where Wright-Patterson Air Force Base and the research, acquisition and intelligence organizations around it draw engineers, analysts and IT staff to Beavercreek and Fairborn, and the Air Force Institute of Technology and the University of Dayton Research Institute supply them.

Requisitions run from Secret for acquisition and engineering support to TS/SCI at the intelligence center.

Ohio has no statewide posting rules, but its largest cities have adopted their own, and an employer with offices in more than one of them needs to know which applies. The rules below are current at the time of writing, each with its source.

Hiring rules in Ohio that matter to employers

Summaries are general information current at the time of writing and are no substitute for counsel.

Pay transparency in job postings
Ohio has no statewide pay transparency statute. The City of Cleveland's Chapter 669 took effect on October 27, 2025 and requires employers with 15 or more employees in the city to include salary ranges or pay scales in all formal job postings, with complaints investigated by the Fair Employment Wage Board. Columbus City Council passed an ordinance on November 4, 2025 requiring private employers with 15 or more employees to provide a reasonable salary range in postings for positions performed within the city, effective December 3, 2025 with enforcement from January 1, 2027. Cincinnati's Chapter 804 requires disclosure of a pay scale to applicants on request.
Salary history
There is no statewide ban, but Cincinnati's Chapter 804 prohibits salary history inquiry and use by employers in the city with at least 15 employees, effective March 13, 2020; Toledo's Chapter 768 bars employers from asking applicants about salary history, effective June 25, 2020; Columbus City Code Chapter 2335 bars employers in the city with 15 or more employees from inquiring into salary history, effective March 1, 2024, with civil penalties of up to 5,000 dollars; and Cleveland's Chapter 669 bars inquiries about current or previous salaries from October 27, 2025.
Fair-chance hiring
Ohio Revised Code Section 9.73, effective March 23, 2016, provides that no public employer, meaning a state agency or political subdivision, shall include on any application form a question concerning the criminal background of the applicant, with an exception allowing notice of legally disqualifying convictions. No statewide rule applies to private employers.
Non-compete agreements
Ohio has no statute on employee non-competes. The Franklin County Law Library's guide explains that under the Ohio Supreme Court's 1975 decision in Raimonde versus Van Vlerah a reasonable non-compete must be no greater than required to protect the employer's legitimate interest, must not impose an undue hardship on the employee, and must not injure the public, and that those criteria remain the test.
At-will employment
The Ohio Legislative Service Commission's brief on employment at will states that either the employer or the employee can terminate employment for any reason that is not contrary to law, and the Ohio Supreme Court restated in Wiles versus Medina Auto Parts (2002) that a general or indefinite hiring is terminable at the will of either party.

Questions about hiring in Ohio

Do the city ordinances reach a Dayton-area contractor?

Cleveland's, Columbus's, Cincinnati's and Toledo's ordinances bind employers and positions within those cities, so a contractor hiring only in Beavercreek or Fairborn is outside them. A contractor with offices in Columbus or Cleveland must follow those cities' posting and salary history rules for positions there.

What clearance levels do Dayton requisitions carry?

Secret for most acquisition, engineering and IT support work around Wright-Patterson, Top Secret for program offices, and TS/SCI for the intelligence center, whose own job postings state that requirement. The Dayton page names the organizations that shape the market.
